Terms of Service

1. These terms

These terms govern your use of the mobile applications published by Singomedia ("we", "us") and of singomedia.co.za. They apply to:

• Mzansi Word Connect
• Mzansi Word Search
• Mzansi Word Brain
• Kasijoints
• Kasitaal Puzzles Hub
• TFM Clubzone

By downloading, installing or using an app, you agree to these terms. If you do not agree, please do not use the app.

2. Licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial entertainment.

You may not:

• copy, sell, rent, sublicense or redistribute the app or its content;
• reverse engineer, decompile or attempt to extract the source code, except where the law expressly permits it;
• remove or alter any copyright, trade mark or other proprietary notice;
• use cheats, automation, bots or modified clients to gain an advantage or interfere with the service.

3. Virtual items and in-app purchases

Some apps offer virtual items such as coins, hints or level unlocks. These items are a limited licence to use a feature inside the app. They are not money, have no cash value, and cannot be transferred, traded or redeemed for cash.

All purchases are processed by Google Play and are subject to Google Play's terms and refund policy. We do not process or store your payment details. Where a purchase fails to deliver, contact us and we will restore the item or refund it at our discretion, in addition to any rights you have under Google Play's policy or consumer law.

Virtual items may be lost if you uninstall the app, clear its data or lose access to the account they are attached to. We may adjust, replace or discontinue virtual items as the games evolve, but we will not remove paid items without providing an equivalent.

4. Advertising

Free versions of our apps display advertising, including through Google AdMob. Ads may be personalised where you have consented; you can limit personalisation in your device settings. Attempting to block, spoof or interfere with advertising in a way that breaches these terms may result in access being withdrawn.

5. Acceptable use

You agree not to use the apps to:

• break any law or infringe anyone's rights;
• upload or share content that is unlawful, hateful, harassing or obscene;
• impersonate another person or misrepresent your affiliation;
• attempt to gain unauthorised access to our systems or another user's account;
• interfere with the operation of the app or place unreasonable load on our servers.

6. Intellectual property

The apps, their artwork, code, puzzles, text and trade marks are owned by Singomedia or its licensors and are protected by copyright and other laws. These terms do not transfer any ownership to you.

7. Availability and changes

We may update, change or discontinue an app or any feature at any time. We aim to keep the apps available but do not guarantee uninterrupted or error-free operation, and we may take the service offline for maintenance.

8. Disclaimer

The apps are provided "as is" and "as available". To the maximum extent permitted by law we disclaim all implied warranties, including fitness for a particular purpose and non-infringement. Nothing in these terms limits rights you have under the Consumer Protection Act, 2008 or other law that cannot be excluded.

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to an app is limited to the amount you paid us for that app in the twelve months before the claim. We are not liable for indirect, incidental or consequential loss, or for loss of data, profit or goodwill.

10. Termination

You may stop using an app at any time by uninstalling it. We may suspend or end your access if you materially breach these terms. Sections that by their nature should survive termination — including intellectual property, disclaimers and liability — will continue to apply.

11. Privacy

Our Privacy Policy explains what information the apps collect and how it is used. It forms part of these terms.

12. Governing law

These terms are governed by the laws of the Republic of South Africa. You and we submit to the jurisdiction of the South African courts, without prejudice to any right you have to bring a claim in your country of residence where consumer law requires it.

13. Changes to these terms

We may update these terms from time to time. The date at the top of this page shows the current version, and continuing to use an app after a change means you accept the updated terms.
